There is a very basic fact that till now there is not proper clarity on the laws related to online gaming which involves gambling in India. We just have one single judgment which has clarified a few of our facts with respect to online gaming gambling and that case is M/S Gaussin networks pvt ltd. V.s Monica Lakhanpal and State of NCT wherein they have discussed the online gambling and stated the following statements:-

  1. A game which involves skills and that involves stakes then that is not considered as gambling.
  2. If people or players are playing games due to the attraction of money then that particular gaming is not validated in India and it is further considered illegal.
  3. If a game played on a digital or online platform is being played for the purpose of gaining money then it shall be considered illegal and punishable even though the same game is legal in the offline world or real world.
  4. There are strict laws on gaming sites with respect to joining the winning hands as if one is doing so then they are promoting gambling and gambling is not legalized in India.

But these case arguments and findings are not in existence as these findings and the case was dismissed during the revision petition filed for the same case.

Therefore, there are still no explicit laws on online gaming which involves gambling.
